I read Aziz Huq’s article in May Atlantic. Fraenkel, Ernst. The Dual State: A Contribution to the Theory of Dictatorship. Possibly published by U of Chicago, Fraenkel was a lawyer in Berlin, a WWI vet & Jewish. He left Germany in 1938 & completed his manuscript in Chicago.

Frankel’s Dual State is similar (current Atlantic) in that the rule of men is imposed on the rule of law.
