I find David Brooks to be unnecessarily arrogant so I don’t read him

Yes. Me, too, on the arrogance... but, I read through it, picking his brain so to speak... seeing if the claims square with things I have read, frames that make sense to me --- and take what seems reasoned from the Brooks claims.

Frankel’s Dual State is similar (current Atlantic) in that the rule of men is imposed on the rule of law.

Not familiar with Frankel's Dual State ... what is the full reference? I did a Substack on the Huq framing of the Dual Law System/State, a key part the Rule of Men State.

I responded. But it did not post. At least I can’t see it! Aziz Huq article in May Atlantic is about Ernst Frarnkel’s The Dual State: A Contribution to the Theory of Democracy.

I read Aziz Huq’s article in May Atlantic. Fraenkel, Ernst. The Dual State: A Contribution to the Theory of Dictatorship. Possibly published by U of Chicago, Fraenkel was a lawyer in Berlin, a WWI vet & Jewish. He left Germany in 1938 & completed his manuscript in Chicago.
